Background Information
The
fragility of the situation in Somalia over the past 20 years has resulted in a
collapse of the health sector which oversees and guides the whole health system,
private as well a public, in order to protect the public interest. The absence
of a regulatory legal framework that implements and monitors health related
laws to define the role of health in relation of other actors, regulations and
standards had led to a number of parallel and fragmented systems and structures
for health provision which did not ensure accountable and transparency in
the health system.
There is a recognised need by the government to define its role in health in relation to other actors which can be accomplished through the development of regulatory legal framework and related public health law/act.
In
this context WHO Somalia is recruiting a team of consultants to develop the
legal framework and the public health law/act.
Purpose
of Consultancy
The
purpose of this consultancy is to draft a legal framework and related public
health law/act, regulations, standards especially in areas of international
health regulations, framework convention on tobacco control, regulations
concerning environmental, occupational health, safety of food and drinking
water, infectious disease control, regulation of medical products, vaccines and
technology and other areas identified by the government indicated by the health
authorities.
This
will be based on the draft Somali Constitution, the health sector strategic
plans and policies and to be in line with national and international
guidelines, agreements and laws.
Brief
description of tasks, duration and expected results
Under
the supervision of WHO Somalia Medical Officer, PHC and the overall guidance of
the WR and in collaboration WHO Regional Office, the Health Authorities,
relevant government institutes, UN agencies and other stakeholders, the
consultancy team will develop a legal framework and relevant public health
law/act.
The
duration of the consultancy is expected to be six months, it will cover the
following tasks:
- Review
documents such as, drafted constitution and existing and/or past health
laws where available and others.
- Use
international experience particularly from fragile states or countries
emerging from crisis with the purpose to select the most appropriate
approaches for developing the legal framework health law/act.
- Travel
to the 3 zones in Somalia for consultative meetings with
healthauthorities, other lines ministries, government institutes and
bodies and relevant stakeholders.

Experiences:
Required:
- At
least ten years combined experience at national and international levels
working in countries of transition and post-conflict to provide sound
methodological, technical advisory and guidance in developing legal
framework and public law/act.
- Broad
knowledge of relevant legal framework, public health law/act and other
relevant areas in transitional and fragile environments.
- Knowledge
of drafting legal framework and related health law/act.
Desirable:
- Advanced
knowledge of Constitution contents, human rights issues, health systems
and health policy frameworks.
- In-depth
knowledge of administrative and governance structures in Somalia.
Skills
- Excellent
writing and presentation skills, and inclusive facilitation and
coordination skills.
- Excellent
communication and negotiation skills, capable of developing and
maintaining effective working relations with high level government bodies
and different organizations.
- Proven
skills in report writing.
Languages:
Excellent
command of written and spoken English required. Somali language skills would be
an asset.
