Assignment Description
The consultant will lead data collection and analysis of Rwanda laws relating to capital/financial services to determine their compliance with the EAC Common Market Protocol.
This
research will be governed by a pre-determined questionnaire and research
process outline.
The
Rwanda country information will contribute to the construction of a regional
index on free movement of capital for the EAC.
Specific Responsibilities:
- Map
Rwanda obligations to the free movement of capital in the EAC Common
Market Protocol.
- Based
on desk legal research, conclude the desk research instrument and lead the
administration of the Rwanda expert panel instrument.
- Participate
in constructing the regional index and narrative report.
- Implement
a country-specific "right of reply" process on preliminary data
collection results.

The World Bank now invites eligible consultants to indicate their interest in providing the services. Interested consultants must provide information indicating that they are qualified to perform the services (brochures, description of similar assignments, experience in similar conditions, availability of appropriate skills among staff, etc. for firms; CV and cover letter for individuals). Background
As part of the implementation process of the EAC Common Market Protocol, which came into force on July 1st 2010, Partner States are undertaking measures to review their domestic legal and regulatory environments to ensure compliance with the Protocol (which guarantees the free movement of goods, labour, capital and services and assures businesses and persons the right to establishment within the bloc) and bring the resulting business environment towards an improved common regional standard.
Part of this process involves negotiating, agreeing on, and implementing legal instruments, policies and programs.
The
success of the common market implementation process depends on (a) whether the
Partner States are adopting legal instruments, policies and programs that
conform to international best practice; and (b) whether these are implemented
correctly and on time at a domestic level.
To ensure that Partner States commitments to build the Common Market become a reality on the ground, it is necessary to set up a monitoring and evaluation system to ensure that decisions are turning into realities, using where possible objective, quantitative measurement tools, such as a scorecard.
The
establishment and the operation of the scorecard must be fully supported by the
Partner States (as an additional instrument for keeping the construction of the
Common Market on course); have a strong methodological foundation; and have
consistency over time in the reporting (to facilitate identifying signs of
progress towards integration goals), be sensitive to policy requirements and
new community priorities, and must be reactive to such trends if it is to
contribute effectively.
The East African Community (EAC) Investment Climate Program is developing and publishing an EAC Common Market Scorecard to achieve the foregoing, upon request by the EAC Secretariat and upon evidence of interest for this monitoring mechanism from Partner States and civil society.
Objective
The program wishes to hire a Short Term Consultant (STC) to lead data collection and analysis of Rwanda laws relating to capital/financial services to determine their compliance with the EAC Common Market Protocol.
This
research will be governed by a pre-determined questionnaire and research
process outline.
The
Rwanda country information will contribute to the construction of a regional
index on free movement of capital for the EAC.
Scope of Work
- Map
Rwanda obligations to the free movement of capital in the EAC Common
Market Protocol.
- Based
on desk legal research, conclude the desk research instrument and lead the
administration of the Rwanda expert panel instrument.
- Participate
in constructing the regional index and narrative report.
- Implement
a country-specific "right of reply" process on preliminary data
collection results.
- Ensure
submission of duly filled data collection forms by respondents and
ministries of EAC, and compile all information sources to ensure data
traceability.
- Participate,
when requested, in developing informational, promotional and media
material for the EAC Common Market Scorecard in relation to the freedom of
movement of capital.
- Any
other reasonable output as agreed by the World Bank Group in the
development of the EAC scorecard.

criteria
Qualifications required:
Qualifications required:
- Degree
in Law and admission to the Roll of Advocates in Rwanda.
- Professional
with at least 5 years of relevant experience in financial services or
commercial legal practice.
- Demonstrate
an understanding of the EAC regional integration process.
- Proven
ability in applying legal expertise to broad range of legal issues relating
to financial services.
- Proficiency
in spoken and written English and French.
- Computer
skills, including strong familiarity with applications such as Microsoft
Word, Excel, PowerPoint and Internet research.

The appointment will be a Short Term Consultant contract initially for a maximum of 40 days, renewable.
