The National Environment Tribunal is established under Part XII of the Environmental Management and Co-ordination Act (EMCA). 

Pursuant to Section 125(1)(a) of EMCA, the Judicial Service Commission of Kenya invites applications from qualified persons for the following position:

Requirements
 

For appointment to this position, an applicant must be in possession of the following qualifications:-
 
1. hold a law degree from a recognized university, or are advocates of the High Court of Kenya, or possess an equivalent qualification in a common-law jurisdiction;
 
2. at least ten (10) years’ experience as a Superior Court Judge or professionally qualified Magistrate; or
 
3. at least ten (10) years’ experience as a distinguished academic or legal practitioner or such experience in other relevant legal field; or
 
4. held the qualifications specified in paragraphs (2) and (3) for a period amounting, in aggregate, to ten (10) years:
 
5. Meet the requirements of Chapter Six of the Constitution and be of high moral character, integrity and impartiality.

In addition, the applicants must demonstrate a high degree of professional competence, communication skills, fairness, good temperament, good judgment in both legal and life experiences and commitment to public and community service.

Notes:-
  • Experience may have been gained in Kenya or in any other country with a Common Law jurisdiction.
  • Knowledge and experience in environmental matters will be an added advantage.
Duties and Responsibilities
 
The Chairperson of the National Environment Tribunal shall be responsible for:-

1) presiding over all proceedings where he/she is present in person;
 
2) participating in hearing and determination of all appeals which come before the Tribunal;
 
3) carrying out inquiry into the appeals lodged including summoning witnesses, taking evidence and calling for production of books and other documents;
 
4) making finding thereupon and notifying parties concerned of the awards, judgements, orders, rulings and decrees issued by the Tribunal;
 
5) making rules of the Tribunal with respect to the filing, hearing and disposal of appeals and other matters before the tribunal; and
 
6) providing requisite leadership to ensure the Tribunal attains a high level of competitiveness and ethical standards in its entire programmes.
