Legal Counsel – Property Management

In keeping with our current business needs, we are looking for a person who meets the criteria indicated below.
Reporting to the Head of Department-Legal & Secretarial Services, the successful candidate will be responsible for providing to the company skilled and professional legal services with an emphasis on drafting, review and research of legal or quasi legal documentation relating to the property / conveyance activities of the company;
Key responsibilities will be to;
- To implement the established processes and SLA for site acquisition & lease completion.
- Undertake the verification, negotiation and completion of document perfection including the updating of legal information on the site acquisition data base (Oracle EPM) for all Properties. Ensure quality control in the drafting/preparation of legal documents required for ALL Properties.
- Undertake cost control of legal fees to external counsel for BTS lease completion to ensure that the same are within agreed rates.
- Prepare monthly status reports from Oracle EPM capturing status of all agreed KPI’s.
- Flag and notify relevant internal customers on statutory requirements for site acquisition and location of facilities e.g. changes in land laws, NEMA regulations as prescribed by law and to advise on how compliance can be best achieved.
- Organize periodical training on legislative changes in land law for site agents and implementation staffers.
- Liaise with internal customers to advice on the renewal, variation and or surrender of leases and or tenancy agreements for all the Company’s Properties.
- Ensure quality control in the drafting/preparation of commercial
- Represent the department in the company’s tender evaluation committee as constituted from time to time.
- Undertake detailed legal opinions on property matters that require legal/ statutory interpretations.
- Diligently perform litigation management tasks for suits arising from Properties under the Legal Counsels portfolio and to keep the General Counsel informed of any developments as soon as they occur.
- Occasionally deputize for the General Counsel during his/her absence and to ensure the continuity of legal services within the assigned mandate.
- Effectively manage the budget and other resources assigned to the section.
The ideal candidate should possess the following skills & competencies;
- Degree in Law from a reputable commonwealth university ( 2nd class and above) and completion of Diploma of the Kenya School of Law
- Advocate of the high court of Kenya of at least three – four years standing.
- Other post graduate diplomas or certificate courses in legal matters such as arbitration/mediation , IP, negotiation skills,
- At least 8 years’ experience in conveyance/land laws, commercial law, good knowledge of Criminal and Civil Procedure Codes excellent knowledge of telecommunications, legal and regulatory environment.
- At least 1 year of experience in a people and process management position.
